Terms of Service

Welcome to The Voice They Leave. These Terms of Service ("Terms") govern your use of the website, apps, and services (together, the "Service") operated by The Voice They Leave ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. What we do
We help you record and publish a memorial video, host it on a private URL, and generate a QR code you can affix to a headstone, plaque, or keepsake so that visitors can scan and watch. We may also offer optional paid packages that are delivered entirely remotely: we guide the interview over a video call, you record on your own device with our coaching, and our team edits and publishes the finished film. We do not travel to film in person.
2. Your account
You are responsible for keeping your login credentials secure and for everything that happens under your account. You must be at least 18 years old, or the legal age of majority in your jurisdiction, to open an account. You agree to provide accurate information and to update it when it changes.
3. Your content
You own the videos, photos, names, dates, and other content you upload ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transcode, display, and stream it solely for the purpose of operating the Service — including making it viewable at the public memorial URL you choose to share. This license ends when you delete Your Content, except for copies retained in ordinary backups for a reasonable period.
You represent that you have the rights and permissions needed to upload Your Content and to grant this license, including permission from every identifiable person featured in it.
We will not sell Your Content, license it to third parties, or use it to train AI models. If we would like to feature your memorial in marketing, we will ask for your written permission first.
3c. Business and organisation stories
If you order a story page for a business, institution, or other organisation, you confirm that you are authorised to act for it, and you grant us permission to use the business name, your name, likeness and voice, the organisation's logo and trademarks, and any photographs or historical materials you supply — solely to produce, host, and display the page you ordered.
You retain ownership of the finished recording and of every asset you supplied, and may download and reuse the finished film on your own website and channels. We will not use business footage in our own marketing without your written permission, and we will remove the page on written request from an authorised representative.
3a. Our intellectual property
Everything that makes up the Service other than Your Content belongs to us or our licensors: the The Voice They Leave™ name, logo, and brand; the software, database design, and publishing and QR workflows; the page designs, layouts, and copy; our guides and FAQ; and our demonstration memorial, sample stories, and promotional reels. These are protected by copyright, trademark, and where applicable trade secret and patent law. All rights reserved.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose — creating, publishing, and sharing your own memorial. You may not copy, modify, reverse engineer, scrape, mirror, resell, or create derivative works from the Service, nor use our name or logo in a way that implies endorsement or affiliation. If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without obligation to you.
3b. Copyright complaints
If you believe material on the Service infringes your copyright, email hello@thevoicetheyleave.com with the subject line "Copyright notice", identifying the work, the memorial URL, your contact details, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your signature. We remove clearly infringing material, notify the memorial owner so they may file a counter-notice, and terminate repeat infringers.
4. Acceptable use
You agree not to use the Service to:
- upload content that is unlawful, harassing, defamatory, sexually explicit, or that infringes another person's rights;
- impersonate a deceased person without authority from their next of kin or estate;
- attempt to gain unauthorized access to another user's memorial or account;
- scrape, resell, or bulk-download the Service or other users' content.
We may remove content that clearly violates these rules or applicable law, and we may suspend or terminate accounts that repeatedly do so.
5. Payments and packages
Some features are one-time paid packages. Prices are shown at checkout in US dollars unless stated otherwise. Payments are processed by Stripe. Refunds are covered by our Refund Policy.
6. Hosting commitment
When you purchase a package, we commit to hosting the resulting memorial page and QR code as long as the Service exists. If we ever have to shut the Service down, we will give you at least 90 days' notice and a way to download your video files so you can move them elsewhere.
7. Availability and changes
We work hard to keep the Service running, but we don't guarantee uninterrupted availability. We may update, add, or remove features. If we make a material change that reduces the Service you paid for, we'll let you know.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. On termination, we may delete Your Content after a reasonable grace period.
11. Governing law
These Terms are governed by the laws of the state where The Voice They Leave is registered, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that state.
12. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll notify you by email or in-app. Continued use of the Service after the change means you accept the updated Terms.
